Class Action Lawsuits Filed on Behalf of Some, But Not All, Michigan Students

Class Action Lawsuits Seeking Fair Refunds for Tuition, Room and Board, have been Filed Against Some Michigan Schools—Are You Protected?

Students at Grand Valley State University, Michigan Tech, Oakland University and Saginaw Valley State University are not covered by suits filed against other schools.

Representing students at Michigan State University, Wayne State University, University of Michigan, Central Michigan University, Eastern Michigan University, Northern Michigan University, Lake Superior State University and Western Michigan University, Fink Bressack has filed lawsuits seeking class action relief.

The lawsuits argue that the universities have unfairly refused to issue adequate refunds for housing, meals, tuition and other fees—students were charged for services they are not going to receive. As of May 12, 2020, no suit has been filed against Ferris State University, Grand Valley State University, Michigan Tech, Oakland University or Saginaw Valley State University

All of these schools refuse to refund any portion of tuition payments, despite the shift to online classes. Also, after urging students to leave university housing with more than 40% of the semester remaining, some of these schools are even refusing to provide complete pro-rata refunds of charges for housing and for meals.

“That’s just not fair,” said David Fink, the managing partner of Fink Bressack.

“We filed these lawsuits to protect the students. Nobody is blaming the universities for the current situation, but the students shouldn’t be forced to subsidize their schools during these difficult economic times.”

A semester of tuition at these schools ranges from around $7,000 for in-state students to more than $25,000 for out of state students.  But, not one of these schools has agreed to provide tuition refunds that account for the significant differences in value between in-person and online classes.
